Rescinded Reenactment of the Department of Justice

- Elaboration & Reasoning:
The Department of Justice is responsible for the serving of justice and enforcement of law, headed by the Minister of Justice.
The fundamental roles of the Minister are to:

• Oversee court proceedings, such as lawsuits
• Oversee law enforcement (police)
• Appoint Police Officers
• Advise the Prime Minister on the appointment of Judges
• Provide assistance to Parliament and the Prime Minister on matters of law or procedure
• Represent the Government in lawsuits

With the introduction of the Department of Justice, it’s essential to define a line between Server Staff and Justice Department responsibilities. The following Laws would no longer be a staff responsibility and instead, Justice Department responsibilities:

• PvP Laws
• Vehicle Laws
• Trespassing
• Unpaid Loans
• Contempt of Court (Proposed; see Court)

Court
The court would be located on the forum, where anyone can create a new Lawsuit against another player, company, or the Government.
With this, Judges would be necessary. Judges would be appointed, alongside the advice of the Minister of Justice, by the Prime Minister and confirmed by Parliament. Should a Judge no longer be deemed suitable to carry out his or her duties faithfully, Parliament has the ability to impeach judges, with a motion of no confidence. There can only be 3 Judges.
Lawsuits can range from a player suing another player for murder to not getting paid from their employer. For efficiency, players would represent themselves.
Lawsuit process:

1. Citizen creates a Lawsuit, providing a detailed explanation of what happened
2. Judge summons Defendant (player being sued); Upon summoning the Defendant, the Judge must send the Defendant mail in game notifying of the outstanding lawsuit and provide a link or guidance on how to view the lawsuit’s thread.
3. The Defendant then has 2 days to acknowledge the case. The Defendant can either accept the case being brought forth him or fight the lawsuit and provide their story of events.
   1. If the Defendant accepts the case, the Judge would then provide a closing statement and announce the penalties (if any; ect.), and adjourn court.
   2. If the Defendant fights the case, the Judge would hear the case further. The Judge holds the rights to call in witnesses and allow for testimony.

Of course, if both parties wish, they have the right to settle outside of court and close the Lawsuit.

vs. Government:
If a Lawsuit is filed against the Government, the Government would be represented by the Minister of Justice. The Government has 3, instead of 2, days to acknowledge the case.
Examples of a case that could involve the Government:

• Police Office abuses their permissions, or doesn’t issue proper punishments..
• Government repossessed player’s land without a proper notice.

vs. a company:
If a Lawsuit is filed against a company, the company can be represented by any player on the company's payroll, determined by the company’s owner. Companies have 2, instead of 2, days to acknowledge the case.

vs. a city:
If a Lawsuit is filed against a city, the city can be represented by the Mayor or a city council member, determined by the Mayor or city council. Cities have 3, instead of 2, days to acknowledge the case.

Additionally, citizens can bring forth a traffic case to the court if they believe that they have improperly stopped or fined by a Police Officer during a traffic stop.
Citizens have 1 day from the time that the traffic stop occurred to fight it in court.
Traffic Case process:

1. Citizen creates a Traffic Case, providing details of the traffic stop. (Why they were pulled over, Officer(s) that pulled them over.)
2. Judge summons Police Officer(s); Upon summoning the Police Officer(s), the Judge must send the Officer(s) involved mail in game notifying of the outstanding Traffic Case and provide a link or guidance on how to view the Traffic Case’s thread.
3. The Officer then has 2 days to acknowledge the case. The Officer must provide his story of accounts.

If no further discussion proceeds based from the Officer’s accounts, the Judge will provide an outcome and adjourn the court.

Court Integrity
In order to protect the court’s integrity, the following Law is proposed:

• Contempt of Court: If an individual or individuals disrupt the court of law, they face a fine, imprisonment, and if applicable, the case dismissed.

Threatening or bribing witnesses, being out of line during court proceedings, or creating false/irrelevant and unnecessary court cases could be cases of contempt of court. The Judge handling the proceeding would have the right to hold someone in contempt of court if they deem necessary.

Law Enforcement
To enforce the Laws the Justice Department is responsible for doing, Police Officers would be established.
Police Officers would have full jurisdiction in all cities and roadways.
Abilities and Power

• Respond to unwanted PvP/murder reports
  • If no Police Officer is present at the time of a murder as outlined by the PvP Law, the victim would have valid reason to create a lawsuit. Provided proof is added, these sorts of lawsuits should be swift.
• Patrol roadways and pull players over
  • Conduct traffic stops for roadway offenders
• Patrol Government buildings
• Respond to trespassing reports
• Protect high government officials, such as Ministers, when needed
• Police Officers would get a blue Police Car, a jail stick and access to other permissions such as to jail and handcuff players
