Anti-Government Shutdown Act
The Council of Ministers enacts:
Section 1. Short Title
(1) This Act is the Anti-Government Shutdown Act.
Section 2. Commencement
(1) This Act shall come into effect immediately upon passage.
Section 3. Purpose and Reasoning
(1) The purpose of this Act is to ensure the continuous and effective functioning of the executive branch by providing a mechanism to fill unoccupied ministerial positions when no candidates come forward.
(2) By allowing the Council of Ministers to temporarily assign an existing Minister to oversee an unfilled Ministry, this Act helps prevent stagnation in governance and ensures all departments remain operational.
Section 4. Council Appointment Powers for Unfilled Ministries
(1) If two consecutive Ministerial Elections or Special Elections fail to produce a candidate for a specific ministerial position, the Council of Ministers may, by majority vote, appoint one of its sitting Ministers to concurrently serve in the unfilled ministerial role.
(2) The separation of powers restriction prohibiting a Minister from holding multiple portfolios shall be waived solely for the purpose of this temporary appointment.
(3) The appointment shall remain in effect until:
(a) A candidate is elected and approved to fill the unoccupied ministerial role, or
(b) The end of the current Council of Ministers Term, whichever comes first.
(4) Ministers appointed under this section shall retain full authority over both their original and temporary departments, unless otherwise restricted by law.
