Establish the Judicial Courts


The Parliament of Stratham enacts:

Section 1. Short Title

(1) This Act is the Judiciary Act.

Section 2. Commencement

(1) All provisions shall come into effect upon signage.

Section 3. Reasoning

(1) The Supreme Court is the highest court and most powerful court of the land, this entails that we must put the most knowledgeable and experienced lawyers on it.

(2) Having only a Supreme Court limits the legal field to only extremely talented individuals.

(3) Re-establishing the Circuit Court and District Court allows it to expand this field to match all players regardless of their legal experience.

(4) We used to have it and it’s time to re-establish it because Ryan spent a lot of work writing the judicial guides and changing it now is bad.

Section 4. Supreme Court Clarification of Powers

(1) The Supreme Court has original jurisdiction in cases that involve the removal of a Constitutional Officer, Member of Parliament, or Speaker of Parliament.

(2) The Supreme Court maintains oversight authority over inferior Courts through the Chief Justice.

(3) If a Justice takes a case to a lower court, the Justice must recuse themselves in case of an appeal.

(4) The Supreme Court may decide where a case is heard in case there is no clear jurisdiction.

Section 5. Circuit Court

(1) The Circuit Court shall be composed of 3 Judges.
  1. The most Senior Judge as determined by the length of their tenure shall be the Chief Judge of the Circuit Court.
  2. The Circuit Court has original jurisdiction over appeals from the District Court, civil cases and criminal cases in which the value of damages is in excess of 5,000kr or more.
  3. The Circuit Court shall have the power to exercise the power of lower courts
  4. The Circuit Court shall have the power to declare a mistrial in an appeal, in the case a mistrial is declared, the case shall be heard again in its original court with a different judge presiding.
  5. In the case a Judge from the Circuit Court acted as a Judge for a case in the District Court, they must recuse themselves from any appeal case in the future relating to it.

Section 6. District Court

(1) The District Court shall be composed of 3 Judges known as Magistrates.
  1. The District Court shall have original jurisdiction over disputes within civil cases, and criminal cases in which the value of damages is under 5,000kr.
  2. Shall have the power to issue warrants to the Government.

Section 7. Definition Clarifications

(1) All Judicial Officers are Judges of the various courts. Justices are the Judges of the Supreme Court.
