I. Description of Case
Selmbab and I were happily married with 3 children. I had 2 children from a previous marriage and all was going well. However 9 months in Selmbab left with no warning leaving me as a single father to care for my own 2 children and 3 others that I am lead to believe are never actually mine. This has left me with no money whatsoever to care for my children and fund their educations. He then turned up again a year later and informed me that the children aren't actually mine.

1. As these children aren't genetically mine, I should have no legal obligation to care for them
2. I was fed false information from Selmbab that lead me to believe that the children were mine

V. Damages
1. 75300kr in lost money for caring for these children

I. Pleading

My client, Selmbab, pleads not guilty to the accusations brought forth by the plaintiff.

II. Arguments
1. The Plaintiff claims that being made a single parent has led to his financial struggles, causing difficulties in the "care for (his) children and funding of (their) educations" justify the proposed damages. However, the Plaintiff has publicly explained these "financial struggles" as a consequence of other factors, such as his gambling addiction which has led to the loss of at least 50,000 Krunas (Evidence #1), therefore indicating these struggles have only materialised from irresponsible spending habits, as opposed to my client's period of absence.
2. The Plaintiff claims to have cared for Selmbab's children during his time away, however it has become clear that the children have been left in a state of destitution (Evidence #2), with even one of my client's children dying during pet_the_fish's care (Evidence #3, Evidence #4). It is arguable that my client should be suing the plaintiff instead for the emotion distress caused by his marital partner's supposed care, as opposed to this outrageous sum of damages requested from Selmbab.
3. The Plaintiff has shown a further lack of care in not knowing the location of the children. When my client asked where the children were, the plaintiff dismissed his question, therefore demonstrating a lack of interest in returning the custody of the children to Selmbab, despite pet_the_fish claiming to be unable to independently care for the children (Evidence #5).
4. There is no hard evidence that the children are not the Plaintiffs, my client has clearly stated that he is not certain who the children's biological parent is leaving it a possibility that they are pet_the_fish's, or even the client themselves. Until my client's return from his absence, he claims he was not even aware the children had been born and were in the care of pet_the_fish, so it is therefore unfair to burden him with the proposed damages when the plaintiff's financial struggles are clearly self-inflicted.

Response to the Motion to Dismiss

1. There isn't an attached time as to when I lost 50000kr to gambling. There hasn't been a working casino in Stratham for over a year now so it would be hard for me to loose 50k in the time I was left alone with no casino to go to.
2. In statement 4, the defendant states that there is no evidence that the children were his. However in statement 2, the defendant states that their client has suffered emotional distress from my lack of care for his children, which contradicts the statement that they are his children.
3. I was opposed to disclosing the location of the children as I was concerned for their safety as the defendant has no proof that they are actually his.
