Succession of Power Act
The Council of Ministers enacts:
Section 1. Short Title
(1) This Act is the Succession of Power Act.
Section 2. Commencement
(1) This Act shall come into effect immediately upon passage.
Section 3. Purpose and Reasoning
(1) The purpose of this act is to ensure elections can run uninterrupted and at the correct times.
(2) To ensure that departments & courts can function properly in the event of a lack of leader
Section 4. Succession of Power
(1) The succession of power for the council of ministers is as follows:
Chairman
Deputy Chairman (where elected)
Minister of State
Minister of Justice
Minister of Economy
Minister of Heath
Minister of Internal Development
Minister of Public Affairs
Ministers without Portfolio
(2) The succession of power for the judiciary is as follows:
Chief Justice
Deputy Chief Justice (where applicable)
Justice
Minister of Justice
Minister of State
(2.1) In the event of this succession of power not being able to be fulfilled, court proceedings are to be halted until the necessary positions are filled
Section 5. Succession of power during an election cycle
In the event that elections are not initiated by the Department of State within 24 hours of their scheduled date, or if election proceedings stop for more than 24 hours due to circumstances other than legal action, the Minister of Justice is to enact Section 5 of the Succession of Power Act
(1) The Minister of Justice is to initiate and run elections on behalf of the Department of State to ensure no delay to the election cycle
(2) In the event of the Minister of Justice being unable to initiate elections, power is succeeded by the next senior department employee
Section 5.1. Special Elections
In the event of a special election not being initiated by the Department of State within 24 hours of their scheduled date, or if election proceedings stop for more than 24 hours due to circumstances other than legal action, the Minister of Justice is to enact Section 5.1 of the Succession of Power Act
(1) The Minister of Justice is to initiate and run special elections on behalf of the Department of State to ensure no delay to the election cycle
(2) In the event of the Minister of Justice being unable to initiate special elections, power is succeeded by the next senior Department of Justice employee.
Section 6. Succession of power within departments
(1) Upon swearing in, the minister is to announce to the chairman their deputy minister within 5 days.
(2) In the event of planned absence, the deputy minister is to take up the roles of the minister for the absence period. If the absence is longer than 2 weeks, the minister or chairman must announce this to the public
(3) In the event ministerial resignation, the deputy is to take the role of minister until a new candidate is elected and sworn in.
