Establish and clarify proper guidelines for the removal of a government official from their position


The Parliament of Stratham enacts:

Section 1. Short Title

(1) This Act is the VonC act

Section 2. Commencement

(1) All provisions shall come into effect upon signage of this bill.

Section 3. Reasoning

(1) Clarification is needed for Votes of no Confidence (referred to henceforth as “VonC”)

Section 4. Definitions Clarification

(1) Define “Cabinet Member” as any member of the executive branch of government serving as the Prime Minister, Deputy Prime Minister, Department Minister, Deputy Department Minister, Attorney General.

(2) Define “Member of Parliament” as any member of the legislative branch of government serving as a Member of Parliament, Speaker of Parliament, or Deputy Speaker of Parliament

(3) Define “Judge” as any member of the Judiciary Branch of Government

(4) Define “High Ranking Government Official” as either a Cabinet Member, Member of Parliament, or Judge.

(5) Define “member of public” as any player with a Join Date of more than 2 weeks and a /bcseen of 6hrs. This does not include High Ranking Government Officials

Section 5. Conditions for all Votes of no Confidence

(1) The reason for initiating a Vote of no Confidence must be clear and proven beyond reasonable doubt.

(2) Should the Player with their position removed feel that the conditions for the Vote of no Confidence were not fully met and wish to challenge the Vote, they may do so in courts.

(3) This bill will overrule any existing laws regarding Votes of no Confidence, including but not limited to bills, legal concepts, and regulations set by the Prime Minister.

Section 6. Votes of no Confidence for a Non-Parliament High Ranking Government Official

(1) A vote of no confidence can be initiated by any member of public or High Ranking Government Official by proposing it in the Public Referendums channel on Forums.

(2) These conditions apply to all High Ranking Government Officials that are not Members of Parliament.

(3) To initiate a vote of no confidence, a forum post must be made with 5 players replying and showing open support for the Vote. Reactions do not count.

(4) Once this step is fulfilled, a vote will be initiated in Parliament regarding the removal of said Official. Should this vote receive 4/5 votes in favour of removing said Official, the Department of State will be responsible for removing said Official from their position.

(5) Should the Vote not receive parliamentary backing, the Department of State will be responsible for initiating a public Vote of no Confidence. Should this vote receive 10 signatures from members of public, and open support from a High Ranking Government Official, the Department of State will be responsible for removing said Official from their position.

Section 7. Post Vote Procedures

(1) After the removal of the Prime Minister, the Deputy Prime Minister shall replace the Prime Minister until the end of their term. Should the Deputy Prime Minister be unavailable, the order of succession listed in the Constitution will be used.

(2) Any removed Official may not be in the position of Minister, Deputy Minister, Prime Minister, Deputy Prime Minister, Member of Parliament, Attorney General, or Judge for the remainder of the term. The Official will not be up for consideration for any of these positions until then.
