- Title: Appeal Process Guideline.
- Type: (Amendment)
- Reasoning: We currently do not have a guideline as to how an appeal would work in the court system. As an appeal is different from a lawsuit, so too must we have a different way of doing things. This bill will help judges and temporary judges be able to run appeals smoothly and effectively.
- Bill: When a Court recieves an appeal, the court must take the following steps:
1. Check to see if any Judges have any conflicts of interest. If so, the Judicial Backup Act must be invoked to bring the SoP on and/or additional members of Cabinet to act as temporary Judges.
2. The Court must respond to the appeal with all three Judges ready to handle the case. The Head Judge, the Judge who will make the posts on the behalf of the court, will be the most senior Judge on the bench. If there are no senior judges on the bench, then the SoP will become the Head Judge. If the SoP cannot be the Head Judge, then the DoJ Minister will be Head Judge. The Head Judge will call for a defense against the appeal from a lawyer of the defense's choosing.
3. The Defense will be allowed to make a case as to why the appeal should be denied. Providing evidence and making a written argument.
4. The Judges will then deliberate on the evidence and arguments made to them. After deliberation between the Judges, each Judge will make a decision voting for or against the appeal. They will then each write a legal opinion as to how they came about their decision and why they are voting the way they are and submit the opinion to the Head Judge.
5. The Head Judge will then post in the Court case the opinion of the Court. The Court will base its verdict on the majority legal opinion, whether it be for or against the appeal. The Head Judge will give a small write up of the case, provide the opinions of the judges, give the verdict and court decision.
6. The Head Judge will then close the Court case.
