Redefine punishments for substances following the new classification system


The Parliament of Stratham enacts:

Section 1. Short Title

(1) This Act is the Controlled Substances Act.

(2) Rescind the Controlled Substances Act

(3) Rescind the Criminal Reform V.2 Act

Section 2. Commencement

(1) All provisions shall come into effect upon passage.

Section 3. Reasoning

(1) According to The Weed Act, Lumnas root and Docweed have beneficial side effects to users with no negative side effects. Therefore there is no legitimate reason as to why the government must punish users of it for simply not having a card allowing so.

Section 4. Classification of Substances.

(1) Create the classification of Schedule 0 substances.
(a) Lumnas root and Docweed shall be assigned under the classification of Schedule 0 substances.
(b) It shall be legal for all citizens to possess, use, distribute, and produce these substances.

(2) Create the classification of Schedule 1 substances.
(a) Fireweed, Puffweed, and Badroot shall be assigned under the classification of Schedule 1 substances.

Section 5. Schedule 0 Substances

(1) Citizens have the right to possess up to 2 stacks of schedule 0 substances on their inventory.
(2) Citizens have the right to possess up to 108 stacks of Schedule 0 substances at their shop.
  1. In order for citizens to be able to possess this amount they must have a registered company with the DoE.
  2. They may only possess the substances at their registered company HQ or any other company location.
  3. Citizens may possess only up to 54 stacks if they do not have a registered company with the DoE.
Section 6. Definitions

(1) Define Possession of Schedule 1 substances as “ The act of possessing an amount over the limit of Badroot, Puffweed, or Fireweed.”
(a) Outlaw Possession of Schedule 1 substances.
(b) This crime shall receive the punishment of a Class 2 Misdemeanor.

(2) Define Distribution of Schedule 1 substances as “The act of selling or distributing Schedule 1 substances or possessing Schedule 1 substances with the intent to sell or distribute.”
(a) Outlaw Distribution of Schedule 1 substances.
(b) This crime shall receive the punishment of a Class 3 Felony.

(3) Define the Use of Schedule 1 substances as “The act of using Schedule 1 substances by means of consumption.
(a) Outlaw Use of Schedule 1 substances.
(b) This crime shall receive the punishment of a Class 1 Misdemeanor.

(4) Define Production of Schedule 1 substances as “The act of producing Schedule 1 substances or being in possession of a farm in order to perform such.”
(a) Outlaw Production of Schedule 1 substances.
(b) This crime shall receive the punishment of a Class 2 Felony.

(5) Define Trafficking of Schedule 1 substances as “The act of distributing or possessing Schedule 1 substances in excess of 27 stacks.”
(a) Outlaw Trafficking of Schedule 1 substances.
(b) This crime shall receive the punishment of a Class 1 Felony.

(6) Define Possession of Schedule 0 substances in excess as “The act of possession of more than 2 stacks of Schedule 0 substances in your inventory.”
(a) Outlaw Possession of Schedule 0 substances in excess.
(b) This crime shall receive the punishment of a Class 3 Misdemeanor.

(7) Define Distribution of Schedule 0 substances in excess without registration as “The act of possession of more than 54 stacks of Schedule 0 substances at a plot that is not registered with the DoE as a business.”
(a) Outlaw Distribution of Schedule 0 substances in excess without registration.
(b) This crime shall receive the punishment of Class 3 Felony.

(8) Define the Distribution of Schedule 0 substances in excess with registration as “The act of possession of more than 108 stacks of Schedule 0 substances at a plot that is registered with the DoE as a business.”
(a) Outlaw Distribution of Schedule 0 substances in excess of registration.
(b) This crime shall receive the punishment of a Class 3 Misdemeanor.

(9) Define Trafficking of Schedule 0 substances as “The act of possessing more than 10 stacks of Schedule 0 substances in your inventory.”
(a) Outlaw Trafficking of Schedule 0 substances.
(b) This crime shall receive the punishment of a Class 1 Felony.

(10) The Department of Justice has the authority of enforcement over these crimes.

(11) The Department of Justice shall destroy all farms and confiscate any excess Schedule 0 or 1 drugs as defined by legal limits.

(12) Classification of Punishments shall follow the Criminal Reform V.3 Act.
