Reform judicial punishments

The Council of Ministers enacts:

Section 1. Short Title

(1) This Act is the Judiciary Act.

Section 2. Commencement

(1) All Provision(s) shall come into effect upon passage.

Section 3. Reasoning

(1)

Section 4. Rules of Court

(1) Whoever knowingly testifies or makes statements to an Officer of the court regarding a case within the laws of the Republic of Stratham that are untrue, shall be guilty of Perjury.
  1. The Judiciary shall have the power to issue charges to any individual in which they believe to be committing Perjury.

(2) Whoever acts in a manner not consistent with the rules of the court or disobeys a lawful order of the court shall be held in Contempt of Court.
  1. The Judiciary shall have the power to hold any person(s) in Contempt of Court.

(3) Whoever attempts to influence a Federal Judge by actively protesting, threatening, or bribing in order to influence an outcome of an ongoing case shall be guilty of Influencing a Federal Judge.

Section 5. Rules of Court Punishments

(1) Perjury
(a) 1st Offense: 500kr Fine.
(b) 2nd Offense: 1000kr Fine + temporary disbarred for 1 month.
(c) 3rd Offense: 1250kr Fine + permanently disbarred.
(2) Contempt of Court
(a) 1st Offense: 250kr Fine.
(b) 2nd Offense: 500kr Fine.
(c) 3rd Offense: 1000kr Fine + 10 minutes Jail.

(3) Influencing a Federal Judge
(a) 1st Offense: 1000kr Fine + 10 minutes jail + temporarily disbarred for 1 month.
(b) 2nd Offense: 1500kr Fine + 15 minutes jail + temporarily disbarred for 3 months.
(c) 3rd Offense: 2000kr Fine + 20 minutes Jail + permanently disbarred.

(4) All permanent disbarring can be appealed to the Supreme Court by filing suit against the Stratham Bar Association after a minimum of 3 months have passed from the date of disbarment.

Section 6. Writs

(1) Writs are orders issued by the legal authority of the Court.

(2) The following below are hereby established as Writs:
(a) “Certiorari” shall be issued by the Supreme Court ordering that a court decision be set aside when found to be conflicting with the law.
(b) “Mandamus” shall be issued by the courts ordering a government agency, office holder, lower court, or corporations to perform an act according to their duty. Only the Supreme Court may issue a Writ of Mandamus to an office holder.
(c) “Habeas Corpus” shall be issued by a Court to order an incarcerated individual to be released unless the government can prove they are being held under legal grounds.
(d) “Quo Warranto” shall be issued by a Court to order the holder of a position or holder of public office to produce evidence of their authority to exercise their power or right.

Section 7. Statute of Limitations

(1) All criminal prosecutions against an individual must be filed in court within 2 months of the alleged offense being committed.
(a) High Crimes against the Republic of Stratham as determined in future and current Legislation shall not be under the time constraints of the statute of limitations

(2) All civil proceedings against an individual must be filed within 1 month of the offense being committed for claims relating to slander or defamatory statements, breach of contract, advertisement law, and scamming. For all other civil claims, the complaint must be filed within 2 months.
