The Government of Stratham

I. Description of Case
The Plaintiff brings forth the following causes of action and alleges the following against the Defendant:

Currently, the Cabinet of Stratham is creating positions within departments without the constitutional authority to do so. The constitution specifically states that "The Parliament is also responsible for changes to the Government, including government departments, their powers, and positions within them". I repeat, "and positions within them". Despite this explicit statement, the Cabinet has taken it upon themselves to create new roles without the support of the people's representatives, a clear overreach of their constitutional authority. We have defined powers for a reason, so no one branch can become too powerful.

One example of the Governments overreach is the position of Construction Secretary. This position was created to lighten the load (documentation) of the Minister. Nowhere in the constitution does it state that the DoC offers job positions for documentation/paperwork, in fact, this is what the constitution states: "Department of Construction (DoC): Responsible for the construction of government-approved buildings and the highway. The Department also finds locations for new cities and towns. All Constructors and Property Inspectors are a part of this department.". The DoC created a new Government position, not Parliament. The question we bring before the court is: Is it Parliament or Cabinet who are responsible for changes to Government positions? If this question is not answered as "Parliament", then a precedent is set that parliaments powers only exist if the Prime Minister allows them to. Do we really want a dictatorship?

If the Government won't follow the law, why should the citizens of Stratham be expected to?

2. A claim was brought forward that Cabinet has been overreaching their constitutional authority.

IV. Claims for Relief
1. The creation of Government positions, by the Cabinet, without Constitutional Authority
2. The Cabinet has shown clear Constitutional overreach by creating such a role

V. Damages
1. By the power of Judicial review, we ask the court that all Government positions not created by Parliament be removed immediately.
2. We ask that the Government give a public apology within 24 hours of the verdict

Once the courts have decided on this case, we ask Parliament to create a bill that clarifies the constitutional powers over Department positions.

In advancing this form to the court, you acknowledge and concur with the rules of court which highlight the importance of honesty at all times. Moreover, you understand the punishments for breaking these rules and/or committing perjury and deception in the court.

As this case is against the government, the speaker of the house, @Topte may also answer this case. Either of these people can of course nominate someone else to answer for them but I would need to see proof of this nomination.

Good morning,

Unfortunately. In this specifically unusual set of circumstances for the court. I am going to have to close this case in the favour of the plaintiff due to no response from the government.

I therefore award the damages requested. Of course this case is subject to appeal. But to give the government a slight respite to get things in order, I am allowing them 28 days to put these changes into place

The court is now adjourned.
