I. Description of Case

The plaintiff alleges that they met all the same eligibility requirements as the candidates who were permitted to appear on the ballot, including but not limited to qualifications, deadlines, and procedural steps. However, despite meeting these criteria, the plaintiff was unjustly excluded from the ballot, which they argue constitutes an act of election manipulation, violating their right to participate in the democratic process.

2. Monday March 3rd 2025 @ 20:38 CST | Plantiff Declares candidacy via Discord.
3. Tuesday March 4th 2025 @ 00:03 CST | Plantiff Declares candidacy via Forums.
4. Tuesday March 4th @ 17:18 CST | Voting Begins without Plantiff on Ballot.

IV. Claims for Relief
  1. Holding a minimum of twelve hours (12) of active playtime, as seen in /bcseen, by the time the election poll opens.
  2. Having a join date on the BusinessCraft server of more than four (4) weeks, as seen in /jd, by the time the election poll opens.
  3. Holding a minimum of one (1) week of total playtime, as seen in /pt, by the time the election poll opens.
  4. Holding no foreign office of any kind in a state recognized by the Republic of Stratham or otherwise.
  5. Having a Discord account and forums account linked to their in-game account.

V. Damages
1. Election results for the posistion of Minister of State be declared invalid and that a new election be conducted in accordance with the law

4.Public acknowledgment of any wrongdoing, if found, is requested.

Your Honor,
Given that the requested continuance will extend beyond the election cycle, the Plaintiff, respectfully requests that the Court issue a Emergency Injunction to delay the certification of the Minister of State Election - March 2025 results, pending the review and conclusion of this case. A little more time will not cause any harm; it will simply allow for a thorough and fair review, ensuring the integrity of the election process.

I. Reasons


1. It is in the public interest to ensure that the election process is transparent, fair, and free from errors or fraud. A delay in certification ensures that any issues are resolved appropriately, maintaining public confidence in the electoral process.

2. A continuance beyond the election cycle is necessary to ensure that all legal issues are fully addressed, ensuring the fairness and integrity of the election process. Rushing the certification without proper review may result in an unjust or erroneous outcome.

3. If the certification proceeds without resolving the outstanding issues, it could result in a violation of voter rights, disenfranchising individuals whose votes may not have been properly counted or whose participation in the election may have been compromised.

MOTION TO DISMISS

I. INTRODUCTION

The Plaintiff, lxSecondary, alleges that they were unjustly excluded from the election ballot despite purportedly meeting all eligibility requirements. The Plaintiff seeks to invalidate the election results and requests damages, including legal fees and punitive damages. However, the Plaintiff’s claims are legally insufficient and should be dismissed for the reasons set forth below.

II. GROUNDS FOR DISMISSAL

A. FAILURE TO FOLLOW PROPER FORMATTING REQUIREMENTS FOR CANDIDACY DECLARATION

Election procedures require specific formatting for candidacy declarations. The Plaintiff was required to follow one of two specified formats when declaring their candidacy, either on the Forums or via Discord, as demonstrated by other candidates who submitted proper campaign posts. Instead of properly declaring their candidacy, the Plaintiff made a general campaign post for their political party, the IronMight Reform Collective (IRC), rather than a personal declaration of their candidacy for the Department of State.

Evidence provided shows that other candidates submitted campaign materials specifically identifying themselves as individual candidates using appropriate formatting, including visual campaign posters and structured declarations. In contrast, the Plaintiff’s post only promoted the collective candidacies of their party members without an explicit personal statement of intent to run as required by election regulations. Due to this failure, their candidacy was not valid, and their exclusion from the ballot was justified.

B. FAILURE TO STATE A CLAIM UPON WHICH RELIEF CAN BE GRANTED
The Plaintiff has not demonstrated any violation of election laws or procedural rules by the Defendant. Since the Plaintiff did not comply with the required formatting for candidacy declaration, they were not eligible for placement on the ballot. The exclusion was proper and justified under the Law.

C. NO DEMONSTRABLE DAMAGES OR INJURY
The Plaintiff has not provided any evidence of concrete harm suffered due to their exclusion from the ballot. The claims for punitive damages and legal fees are speculative and lack any legal basis. Additionally, the request to invalidate the election lacks merit, as there is no proof of wrongdoing by the Defendant.

III. CONCLUSION
For the foregoing reasons, the Defendant respectfully requests that this Court dismiss the Plaintiff’s Complaint in its entirety with prejudice and grant such further relief as the Court deems just and proper.

I am going to be upholding the motion to dismiss. At no point during the election period did the Plaintiff make a campaign post specifically for their candidacy, either on forums or discord as required per the election declaration requirements. Whilst the plaintiff did make generalised campaign posts on behalf of their political party, it is clear to me upon the review of both the constitution and the declaration requirements set out by the DoS that candidates must make at least one campaign post specifically for their candidacy, which the Plaintiff failed to do. This is shown in the declaration thread by the following sentence, "If you intend to make your campaign post through Discord, use this format to reply to this thread.". The phrase "your campaign post" clearly shows that candidates must make a post specific to their candidacy, and a generalised post on behalf of a political party does not meet this requirement.

With the Plaintiff not making a campaign post specifically to their candidacy either on discord or forums (the declaration does not count as a campaign post) they failed to meet the requirements to be included in the election as laid out in the constitution. Therefore the Department of State was right to not include them in the ballot.

The injunction regarding the result of the Department of State election is now lifted, and the DoS, @Lazy, may now announce the result of the election publicly.
